Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HoodUp mobile app, hoodup.app website and related services. By creating an account, using the app or purchasing HoodUp PRO, you agree to these Terms and the Privacy Policy.

1. Who may use HoodUp

You must be at least 13 years old and must meet any higher age or parental-consent requirement that applies where you live. You must have legal capacity to agree to these Terms. You may not use HoodUp if your account has been permanently banned or if your use would breach applicable law.

2. Your account

You are responsible for accurate account information, keeping sign-in credentials secure and activity carried out through your account. Tell us promptly at info@hoodup.app if you believe the account has been compromised.

Usernames and display names must not impersonate another person or business, infringe rights, mislead users or contain prohibited content. HoodUp may require a username change where reasonably necessary.

3. The service

HoodUp may provide features including:

• car profiles and a virtual garage;
• modification, cost, fitting date and vehicle-history tracking;
• BHP, torque and 0-60 performance logging;
• posts, photos, videos, comments, follows, likes and saved posts;
• registration and MOT lookup;
• feedback and feature-voting tools; and
• HoodUp PRO dashboards, AI analysis, premium vehicle cards, multiple cars, widgets and timelines.

HoodUp is currently in a coming-soon phase. Features, availability, pricing and platform support may change before or after launch. We may add, remove or alter features where reasonably necessary for product, security, legal or technical reasons.

4. User-generated content

Your ownership

You keep ownership of photos, videos, text and other content you create. You grant HoodUp a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, display, distribute and make technical copies of that content only as needed to operate, secure, improve and promote the service. This licence ends when the content is deleted, except for limited copies in backups or material already lawfully shared outside HoodUp.

Your responsibility

You confirm that you own the content or have permission to upload it, and that it does not breach law, privacy, confidentiality, copyright, trade mark or other rights. You are responsible for removing registration plates, faces, addresses or other personal details you do not want to make visible.

Prohibited content and behaviour

You must not post, request, promote or engage in content or behaviour that:

• is illegal, fraudulent, deceptive or infringes intellectual property;
• is hateful, harassing, threatening, bullying, sexually explicit or exploitative;
• reveals private information without permission;
• encourages dangerous driving, illegal street racing, evading police or unsafe vehicle use;
• offers stolen parts, counterfeit goods, weapons, drugs or other prohibited items;
• contains malware, spam, scams, unauthorised advertising or manipulated engagement;
• impersonates another person or falsely claims qualifications, ownership or performance results; or
• interferes with reporting, blocking, moderation, security or normal operation of HoodUp.

Reporting, blocking and moderation

Users can report posts, comments and accounts and can block other users. HoodUp may review reports, remove content, reduce visibility, restrict features, suspend accounts, permanently ban users or preserve evidence where reasonably necessary.

We aim to respond to serious safety concerns promptly, but cannot guarantee that every item is reviewed immediately. For urgent risks, contact the relevant emergency or law-enforcement service as well as reporting the content in HoodUp.

5. Vehicle, registration and MOT data

Registration and MOT information may be supplied by official or third-party sources and can be delayed, incomplete or inaccurate. You must check important information against the vehicle, official records and qualified inspection.

You may only look up a registration for a legitimate purpose. You must not use HoodUp to track, harass, identify or profile another person or vehicle owner.

6. Performance figures and modification safety

Performance figures are entered by users or inferred from the data provided. HoodUp does not verify dyno results, 0-60 times, costs, fitted parts or claims made in posts.

Vehicle modifications can affect safety, reliability, emissions, insurance, warranty, MOT status and road legality. Before modifying a car, seek advice from a qualified mechanic, tuner, engineer, insurer or relevant authority. Never rely on HoodUp as the sole basis for a mechanical or safety decision.

7. AI analysis

HoodUp PRO may provide automated analysis, scores, estimates and suggested next mods. AI output can be inaccurate, incomplete, outdated or unsuitable for your specific vehicle. It is provided for general information and entertainment and is not professional advice.

Do not use AI output to bypass safety checks, tuning limits, insurance disclosure, emissions rules, MOT requirements or road law.

8. HoodUp PRO subscriptions

Purchase and renewal

HoodUp PRO is expected to be offered as an auto-renewing monthly or annual subscription through Apple or Google. The relevant store shows the final local price, trial eligibility, billing period and renewal date before you confirm.

Free trial

Where offered, a 7-day free trial converts to the selected paid plan unless cancelled through the store before the trial ends. Trial availability may be limited to eligible accounts and can vary by storefront.

Cancellation

Cancel through the subscription settings in the Apple or Google account used to purchase. Deleting the HoodUp app or account does not automatically cancel billing. Unless the store states otherwise, access continues until the end of the paid period.

Refunds

Apple or Google controls payment processing and refund decisions. Any statutory rights you have remain unaffected.

Feature access

HoodUp PRO access depends on a valid store entitlement. If a purchase expires, is refunded, is reversed or cannot be verified, premium access may end. Core Free-tier data remains subject to the normal account rules.

9. Acceptable technical use

You must not reverse engineer, scrape, probe, overload, bypass access controls, automate fake activity, exploit vulnerabilities or access data you are not authorised to see. You must not attempt to obtain server keys, private tokens, another user’s account or non-public moderation information.

10. Intellectual property

HoodUp, the HoodUp wordmark, app design, software, databases, graphics and original content are owned by or licensed to the operator of HoodUp. Except for the limited right to use the service under these Terms, no rights are transferred to you.

You may not use HoodUp branding in a way that suggests sponsorship, partnership or endorsement without written permission.

11. Feedback

If you submit ideas or feature feedback, you grant HoodUp permission to use, adapt and develop those ideas without payment or obligation. This does not transfer ownership of unrelated confidential material, and you should not submit information you are not authorised to share.

12. Suspension and termination

You may stop using HoodUp at any time. You can delete your account in the app through Settings → More settings → Danger zone → Delete account or use the web deletion request.

HoodUp may warn, restrict, suspend or terminate an account where reasonably necessary for a serious or repeated breach, legal obligation, fraud, security risk, harmful conduct or protection of users and the service. Where appropriate, we may allow an appeal through info@hoodup.app.

13. Availability and changes

We aim to keep HoodUp available, but the service may be interrupted by maintenance, network failure, third-party services, app-store review, security work or events outside our control. We do not guarantee uninterrupted or error-free access.

We may update these Terms. Material changes may be announced in the app, on the website or by email. Continuing to use HoodUp after an updated date means the new Terms apply, unless law requires another form of consent.

14. Disclaimers

To the fullest extent permitted by law, HoodUp is provided “as is” and “as available”. We do not guarantee the accuracy of user content, vehicle data, performance claims, AI output, benchmarks, MOT information or recommendations.

Nothing in these Terms excludes rights or protections that cannot legally be excluded, including consumer rights and liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

15. Limitation of liability

To the fullest extent permitted by law, HoodUp is not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data, vehicle damage, failed modifications, insurance consequences, fines or losses arising from reliance on user content, AI output or unverified vehicle or modification data.

Where HoodUp is legally liable and liability can be limited, total liability relating to a paid service will not exceed the amount you paid for HoodUp PRO during the twelve months before the event giving rise to the claim. This limit does not apply where law prohibits it.

16. Governing law

These Terms are governed by the law of England and Wales. Courts in England and Wales have jurisdiction, except that consumers may also have rights to bring a claim in the courts of the country where they live.
